Neutralität und Gleichbehandlung sind immer Frage des Vergleichsmaßstabes, im Internationalen Steuerrecht meist Kapitalimport- und Kapitalexportneutralität. Ausgehend von der fast 40 jährigen transatlantischen Kontroverse über die Besteuerung von Warenexporten zeigt die Arbeit, dass dem Welthandelsrecht (WTO) ein eigenes, vom Internationalen Steuerrecht abweichendes Neutralitätsverständnis innewohnt. Dieses ist in der Subventionskontrolle, der Inländergleichbehandlung und dem Meistbegünstigungsprinzip gleichheitsrechtlich normiert. Konkrete Ausformung hat es beim steuerlichen Grenzausgleich für indirekte Steuern erlangt. Die Spruchkörper der WTO bejahen eine ertragsteuerliche Exportsubvention, wenn eine Abweichung von der mitgliedstaatlichen "normative benchmark" vorliegt. Anders die vorliegende Arbeit, welche Steuersubventionen als Abweichung vom welthandelsrechtlichen Neutralitätskonzept bestimmt. Paradoxer Weise verringert dieser Ansatz die Konflikte zwischen beiden Rechtsmaterien und schont somit die mitgliedstaatliche Steuersouveränität.
