Seit der 6. Kartellrechtsnovelle ist die aus dem US-amerikanischen Antitrust-Recht stammende und sodann von der Anwendungspraxis der Wettbewerbsregeln der Europäischen Union aufgegriffene Essential Facilities-Doktrin in § 19 Abs. 4 Nr. 4 GWB kodifiziert. Die theoretischen Grundlagen der Essential Facilities-Doktrin sind trotz ihrer Verankerung in verschiedenen Wettbewerbsordnungen alles andere als geklärt. Dies gilt insbesondere, soweit die Essential Facilities-Doktrin nicht als sektorspezifische Deregulierungsmaßnahme, sondern als allgemeiner Kartellrechtstatbestand ausgestaltet ist. Vorliegende Arbeit analysiert die Essential Facilities-Doktrin anhand ökonomischer Wettbewerbsmodelle der Harvard-School, der Chicago-School und der Austrian-School sowie der Netzökonomie und auf Grundlage der normativen Vorgaben der Wettbewerbsordnungen der Vereinigten Staaten, der Europäischen Union und der Bundesrepublik. Hierbei werden in interdisziplinär-ökonomischer und rechtsvergleichender Analyse verschiedene Ansätze zur Auslegung der Essential Facilities-Doktrin herausgearbeitet, deren Ergebnisse für die Anwendung von § 19 Abs. 4 Nr. 4 GWB fruchtbar gemacht werden.
